Miller shot Henderson in the right shoulder with a Sharp's Carbine on Sept. 8, 1861, at the Co. camp near Duffields. This altercation occurred because Henderson had ordered the arrest of Oldham Herald (a pvt. in Henderson's Co. and apparently a friend of Miller's) on Sept. 7. The Court sentenced Miller to death by firing squad. Execution occurred in the spring of 1862.

Finally, with several other Confederate prisoners, he accepted an offer of freedom from the Union authorities with the provision that he go west for garrison duty at Ft. Laramie, Wyoming. The Confederates agreed to this condition, hoping to escape on their way west or at Ft. Laramie. Their scheme proved futile, however, as there was no opportunity for escape an route, and once in Wyoming, the hostile indians were so numerous that it was suicidal to run the gauntlet.
